Terms of Use.
Terms governing your use of thepaddocksociety.org and any associated digital materials. Distinct from the membership contract; these Terms govern site visitors and prospective applicants. Effective 2026-05-03.
1. Acceptance of These Terms
By accessing or using thepaddocksociety.org (the "Site"), you ("you", "your") agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not access or use the Site. These Terms govern your use of the Site only; the Founding Member Agreement and associated documents (together, the "Membership Documents") govern any membership relationship with The Paddock Society.
2. Operator
The Site is operated by The Paddock Society ("we", "us", "the Society"), a venture of StaaS Fund. Inquiries may be sent to [email protected].
3. Eligibility
You may use the Site only if you are at least eighteen (18) years of age and able to form a binding contract with us. Use of the Site is offered to individuals; commercial use, including data scraping, repackaging, or commercial replication of Site content, is prohibited without our prior written consent. Limited access by reputable AI crawlers and search-engine indexers is permitted as described in our robots.txt.
4. The Site Is Informational
The Site is informational only and does not constitute an offer to sell or a solicitation of an offer to buy any membership, security, investment, or other product. Membership in The Paddock Society is by introduction and interview; submission of an inquiry does not create any obligation on our part to admit you to membership. All membership representations are governed by the Founding Member Agreement and associated Membership Documents, and the Member's signature on those documents (not your use of this Site) creates the contractual relationship.
5. Forward-Looking Statements
The Site contains forward-looking statements about The Paddock Society's intended programming, calendar, partnerships, market context, and projected category outcomes. These statements reflect our current expectations and assumptions and are subject to commercial, regulatory, partnership, and operational confirmation. Forward-looking statements are not guarantees of future events or outcomes; actual outcomes may differ materially. We undertake no obligation to update forward-looking statements except as required by law.
6. Intellectual Property
The Site, including all text, images, video, code, logos, and other materials (the "Site Materials"), is owned by The Paddock Society or licensed to us, and is protected by copyright, trademark, and other intellectual-property laws. You may view and use Site Materials for your personal, non-commercial purposes. You may not reproduce, redistribute, modify, frame, mirror, scrape, or create derivative works of the Site Materials without our prior written consent.
7. The Paddock Society Marks
"The Paddock Society," the Society wordmark, the four-pillar lockup, "TPS Cup," "Founders Call," "Investor Layer," and any other Society-specific marks, names, and slogans appearing on the Site are proprietary to the Society. Use of any Society mark requires our prior written consent.
8. User-Submitted Information
If you submit information to us through the Site (for example, a membership inquiry or contact-form message), you represent that the information is accurate, that you have the right to submit it, and that the information does not violate any third-party right or applicable law. You grant us a non-exclusive, perpetual, worldwide, royalty-free license to use information you submit for the purposes described in our Privacy Policy. We treat membership-application information with heightened care as described in the Privacy Policy.
9. Third-Party Links
The Site may contain links to third-party websites, including but not limited to The Driving Club at Road Atlanta, FARA USA, partner manufacturers, partner facilities, and operators of motorsport events. We do not control these third-party sites and are not responsible for their content, security, or practices. Your use of third-party sites is governed by those sites' terms.

THE SITE AND ALL SITE MATERIALS ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE SOCIETY, ITS PARENT, SUBSIDIARIES, AFFILIATES, OPERATING PARTNERS, OFFICERS, DIRECTORS, MEMBERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE EXCEED ONE HUNDRED U.S. DOLLARS ($100).
12. Indemnification
You agree to indemnify, defend, and hold harmless the Society and its parent, subsidiaries, affiliates, operating partners, officers, directors, members, employees, agents, and licensors from any claim, loss, liability, damage, cost, or expense (including reasonable attorneys' fees) arising out of (i) your use of the Site, (ii) your violation of these Terms, or (iii) your violation of any third-party right or applicable law.
13. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Georgia, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms shall be resolved exclusively by mediation followed by binding arbitration in Atlanta, Georgia, on the same procedural framework as ยง16 of the Founding Member Agreement, or as otherwise required by law.
14. Class Action Waiver
You and the Society agree that any dispute will be resolved on an individual basis and that no dispute will be brought as a class action, mass action, or representative action.
15. Changes to These Terms
We may update these Terms from time to time. Material changes will be posted on this page with an updated effective date. Your continued use of the Site after a change constitutes acceptance of the changed Terms.
16. Severability; Entire Agreement
If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall continue in full force and effect. These Terms (together with the Privacy Policy and any other policies posted on the Site) constitute the entire agreement between you and the Society regarding your use of the Site, and supersede all prior agreements regarding the same subject matter. The Membership Documents (when applicable) govern the membership relationship and are not displaced by these Terms.
